1. Introduction
Welcome to EquitableCommonsLane ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at equitablecommonslane.sbs (the "Service") operated by EquitableCommonsLane.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
EquitableCommonsLane offers upscale yacht charter services, which include:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Our services are contingent on availability and prevailing weather conditions. We retain the right to alter or discontinue services without prior announcement.
3. Booking and Reservations
3.1 Booking Process
To make a reservation for a charter, you are required to:
- Be at minimum 18 years old
- Submit precise and comprehensive information
- Settle the required deposit as illustrated in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A booking is considered confirmed with the fulfillment of payment and our issuance of a confirmation in writing. We hold the authority to decline service to anyone for any reason.
3.3 Availability
Charter bookings are reliant on the vessel's availability and favorable weather conditions. We commit to making reasonable endeavors to meet your preferred scheduling.
4. Payment Terms
4.1 Pricing
All costs are expressed in € and consist of applicable taxes unless stated otherwise. Prices are liable to modifications without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the entire charter fee is due upon reservation
- Final payment: Owed 48 hours prior to the departure of the charter
- Supplementary charges (if any): Are to be paid after completion of the charter
4.3 Payment Methods
We accept principal credit cards, electronic funds transfers, and certified cheques. All payments are processed through protected, encrypted mechanisms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours in advance of departure: Entire amount refundable minus transaction fees
- Within 24 to 72 hours of departure: 50% of the amount is refundable
- Less than 24 hours before departure: No reimbursement is provided
5.2 Weather Cancellations
In case our captain assesses the weather as unsafe, we propose to:
- Reschedule the charter with no additional cost on the next available slot
- Issue a full refund when rescheduling is unattainable
5.3 Mechanical Issues
If mechanical problems arise with the designated vessel, we will strive to offer an appropriate substitute. If an alternative is not feasible, a complete reimbursement will be furnished.
6. Safety and Conduct
6.1 Safety Requirements
All guests are expected to:
- Heed all instructions provided by the crew
- Utilize safety gear as stipulated when necessary
- Disclose any health conditions that may impact their own security
- Keep within the assigned areas on the yacht
6.2 Prohibited Items
The following items are disallowed on the yacht:
- Glassware
- Unlawful substances
- Weapons of any kind
- Animals (except if they have received prior approval)
6.3 Conduct
Patron behavior is required to be courteous at all times. We retain the right to terminate the activity prematurely without reimbursement if the conduct of any participant presents any form of risk or hampers the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
Our responsibility is confined to the total amount paid for the charter. We do not hold liability for:
- Injuries incurred due to passenger carelessness
- Loss or damage to personal effects
- Indirect, sequential, or punitive losses
- Delays due to weather or any other conditions beyond our control
7.2 Insurance Coverage
We possess comprehensive maritime insurance for our fleet and operations. Clients bear the responsibility for ensuring their travel and personal insurance.
7.3 Assumption of Risk
By engaging with our yacht services, you accept that marine activities are inherently risky and you assume accountability for your personal safety.
8. Modifications and Itinerary Changes
We preserve the right to amend routes, schedules, or itineraries in response to safety concerns, meteorological conditions, or operational demands. We shall attempt to offer comparable alternatives wherever feasible.
9. Force Majeure
We are not accountable for any hold-ups, alterations, or cancellations resulted from situations beyond our capacity to control, including, but not confined to:
- Harsh weather conditions
- Natural calamities
- Regulatory actions
- Port shutdowns
- Vessel malfunctions
10. Privacy and Data Protection
Your private data is processed in congruence with our Privacy Policy. By utilizing our service, you concur to our collection and usage of your data as outlined in the Privacy Policy.
11. Intellectual Property
All content on our website, encompassing text, imagery, symbols, and photographs, is guarded by copyright and trademark legislations. Unauthorized reproduction, circulation, or creation of derivative works is prohibited without our explicit consent.
12. Governing Law
These Terms are regulated by the laws in force within Spain. Any disputes shall be resolved in the judicial courts based in Barcelona, Spain.
13. Changes to Terms
We retain the authority to modify these Terms at any given time. Amendments will be published on our platform with an updated date of revision. Continuing the use of our services implies acceptance of the revised terms.
